Penalties and retention

Penalties

BOLI civil penalties of up to $1,000 per violation, plus back wages and interest. Willful failure to pay wages triggers a penalty equal to 8 hours of wages per day (up to 30 days) under ORS 652.150.

Record retention

Two years under OAR 839-020-0080; BOLI recommends three years to align with FLSA.

Allowed, provided employees can access and print records at no cost.
